Welcome to LINXS Communications (“LINXS,” “we,” “us,” or “our”). These Terms and Conditions govern your access to and use of our website at https://www.linxscom.com/, including its informational content, contact forms, quote request forms, and related website features.

LINXS Communications provides business communications solutions, including cloud-based telephone systems, Voice over Internet Protocol (VoIP), SIP trunking, business messaging, call center solutions, video conferencing, fax services, equipment, mobile and desktop applications, and related technical support.

By accessing or using our website, you agree to these Terms and Conditions. If you do not agree, please discontinue use of the website.

These Terms govern general website use. Services purchased from LINXS may be subject to separate written service agreements, order forms, service schedules, acceptable-use policies, and other contractual documents. Where a separate written agreement applies, it governs the relevant purchased services to the extent of any conflict with these website Terms.

Eligibility and Authorized Use

You may use our website only in compliance with these Terms and applicable law.

If you use the website or request services on behalf of a company or other organization, you represent that you are authorized to act on behalf of that organization.

Our services are primarily intended for businesses and organizational users. Certain services, applications, or features may have additional eligibility, technical, or contractual requirements.

Website Information and Service Descriptions

We make reasonable efforts to provide accurate and current information about our products, services, features, equipment, and pricing.

Website descriptions, photographs, feature lists, examples, and promotional statements are provided for general informational purposes. Actual availability, features, pricing, equipment compatibility, installation requirements, and service performance may vary depending on the customer's location, network, selected plan, configuration, and applicable agreement.

Submitting a contact form or requesting a quote does not constitute a binding purchase order or guarantee that a service will be available. Service availability is subject to technical review, applicable requirements, and acceptance by LINXS.

We may correct errors, update website content, modify offerings, or discontinue website features at any time, subject to applicable contractual obligations.

Service Orders and Customer Agreements

Purchases and subscriptions may require a written service agreement, order form, authorization, or other documentation.

The applicable agreement may specify the services and equipment purchased, recurring and usage-based charges, installation requirements, contract duration, renewal provisions, cancellation requirements, service-level commitments, and other conditions.

Customers should review all applicable documents before signing or activating service. A service order is subject to acceptance by LINXS.

These website Terms do not replace or modify a signed customer agreement unless expressly stated in writing by an authorized LINXS representative.

Pricing, Billing, and Payments

Prices displayed on our website are subject to the applicable plan details, service agreement, order form, and any disclosed conditions.

Customers agree to pay applicable recurring charges, usage-based fees, equipment costs, installation or activation charges, taxes, regulatory assessments, and other fees specified in their agreement or order.

Payment methods, invoice terms, billing cycles, payment deadlines, late-payment charges, and applicable refund provisions are governed by the relevant agreement and invoice.

If you believe a charge is incorrect, contact LINXS promptly so the matter can be reviewed. Any billing adjustment will be handled in accordance with the applicable agreement and law.

We may correct pricing or billing errors and will address resulting adjustments as required by the applicable agreement and law.

Service Terms, Renewals, and Cancellation

The initial term, renewal arrangements, cancellation notice requirements, and any applicable early termination charges are established by the customer's signed agreement.

Customers wishing to cancel or transfer service should contact LINXS using the contact information provided below and follow the cancellation procedure in their agreement.

Discontinuing use of a service, disconnecting equipment, or stopping payment does not necessarily terminate a subscription.

Charges, notice periods, refunds, equipment-return requirements, and any prorating of fees upon cancellation are determined by the applicable agreement and law. Any promotional offer or money-back guarantee applies only according to its stated conditions and eligibility requirements.

Telephone Numbers and Number Porting

Telephone number transfers are subject to applicable regulations, carrier procedures, number eligibility, and the information and authorizations required from the customer.

Customers must provide accurate account information and any necessary letters of authorization or other documentation.

Porting dates and completion times may depend on the losing carrier, receiving carrier, and circumstances outside LINXS's direct control. We cannot guarantee a specific porting date unless expressly agreed in writing.

Customers should not cancel existing telephone service prematurely if doing so could interfere with a pending number transfer.

Telephone number portability rights are subject to applicable law and carrier requirements.

Emergency Calling and E911

VoIP and other internet-based telephone services may have important limitations for emergency calling.

Customers must review the emergency-calling disclosures provided with their services and ensure that users understand how to contact emergency services.

Where emergency calling is provided, customers are responsible for supplying and maintaining accurate registered emergency addresses and other required location information. Customers must promptly notify LINXS of changes to service locations or other information that may affect emergency routing.

Emergency calling may be affected by power failures, internet outages, network disruptions, incorrect location information, equipment failures, service configurations, or other circumstances.

Customers should maintain an alternative means of contacting emergency services when necessary, particularly during power or internet outages.

Customers must not assume that a VoIP telephone will automatically communicate its physical location to emergency responders. The specific emergency-calling capabilities and limitations of each service are governed by the applicable service agreement and required disclosures.

Nothing in these Terms excludes or limits obligations concerning emergency calling that cannot lawfully be excluded or limited.

Internet Connectivity and Service Performance

Our cloud communications services may depend on the customer's internet connection, local area network, routers, firewalls, power supply, devices, and third-party telecommunications infrastructure.

Customers are responsible for maintaining compatible equipment, sufficient internet connectivity, appropriate network configuration, and reliable power.

Call quality, latency, availability, and functionality may be affected by congestion, bandwidth limitations, network configuration, internet service providers, equipment, and other factors.

Any uptime commitment, service-level agreement, downtime credit, or service remedy applies only as specified in the applicable written agreement. Nothing in these website Terms overrides an express written service-level commitment.

Acceptable Use

You agree not to use our website, applications, or services to:

  • Violate applicable laws, regulations, or third-party rights.

  • Commit fraud, impersonation, harassment, threats, or unlawful abuse.

  • Send unlawful, deceptive, or unauthorized communications.

  • Conduct unlawful robocalling, automated messaging, or unsolicited marketing.

  • Transmit malware, malicious code, or harmful content.

  • Attempt unauthorized access to accounts, systems, networks, or data.

  • Interfere with service operations, security, or other users' access.

  • Manipulate caller identification or communications in an unlawful or deceptive manner.

  • Circumvent security controls or misuse service features.

  • Use services in violation of applicable carrier requirements or service-specific restrictions.

  •

Customers are responsible for their users' activity to the extent provided by the applicable agreement and law. Customers must ensure that their use of LINXS services complies with applicable laws and any applicable service-specific acceptable-use policies.

Where LINXS reasonably believes that use violates applicable law, threatens network integrity, creates a security risk, or breaches a customer agreement, LINXS may investigate and take appropriate action consistent with the applicable agreement and law. Suspension or termination of purchased services will be governed by the applicable contractual provisions and legal requirements.

Messaging, Marketing, and Call Recording

Customers using business messaging, automated dialing, call recording, transcription, or related features are responsible for complying with applicable federal, state, and local laws.

Depending on the activity, these requirements may include obtaining consent, identifying the sender, providing opt-out mechanisms, complying with do-not-call restrictions and calling-hour limits, maintaining records, and meeting applicable carrier registration or campaign requirements.

Customers must obtain legally required consent before recording or transcribing calls or messages and must provide required notices to affected individuals.

Customers must also ensure that communications lists, contact information, and other information submitted through LINXS services may lawfully be used for the intended purpose.

LINXS does not provide legal advice regarding customers' communications campaigns. Customers should consult qualified counsel when determining their legal obligations.

Customer Accounts and Security

Customers must provide accurate account information and protect their account credentials.

Customers are responsible for managing user access, assigning appropriate permissions, and taking reasonable steps to prevent unauthorized account access.

Notify LINXS promptly if you suspect unauthorized access, compromised credentials, fraudulent usage, or a security incident involving your account.

LINXS may take reasonable measures to protect its systems and customers, including verifying account authority, investigating suspicious activity, and restricting access where necessary and permitted by the applicable agreement and law.

Privacy and Personal Information

Your use of our website is also subject to our Privacy Policy, available at:

https://www.linxscom.com/privacypolicy

Our Privacy Policy describes how LINXS collects, uses, discloses, retains, and protects personal information and explains the privacy rights and choices that may be available to you under applicable law.

Depending on how you interact with LINXS, the information processed may include contact details, account information, website usage information, technical logs, billing information, and telecommunications-related information.

When you request a quote, contact our team, register for an account, or use our services, you should provide accurate information and avoid submitting personal information that is unnecessary for the requested purpose.

The Privacy Policy explains how to contact LINXS about privacy questions and requests. Where a provision of the Privacy Policy concerns the handling of personal information, it should be read together with these Terms and any applicable customer agreement.

Cookies, Analytics, and Website Tracking

Our website and service providers may use cookies, server logs, analytics tools, pixels, and similar technologies where implemented.

These technologies may collect information such as IP addresses, browser and device information, pages visited, timestamps, referring pages, and interactions with website content.

We may use this information to operate and secure our website, troubleshoot technical issues, analyze website usage, improve performance, and understand how visitors interact with our content.

If LINXS uses third-party advertising services, those providers may use their own technologies to measure advertising effectiveness or personalize advertising, subject to applicable law and any required privacy choices.

You may manage certain cookies through your browser settings. Blocking certain cookies may affect website functionality. Where required by law, applicable consent mechanisms and privacy choices will be provided.

Further information about these practices is available in our Privacy Policy.

Mobile and Desktop Applications

LINXS may offer mobile or desktop applications to support its communications services.

Depending on the application, its features, and the permissions you grant, an application may access contacts, send push notifications, use device storage, or process other technical information needed to provide its functionality.

For example, an application may use authorized contact access to display contacts or support contact-related features, push notifications to provide service or account alerts, and device storage for supported downloads or profile-picture functions.

You can manage application permissions through your device or operating system settings. Disabling certain permissions may limit functionality.

Application features and permission requirements may change as applications are updated. The applicable privacy disclosures and third-party terms also govern relevant data handling.

Third-Party Services and Integrations

Our website and services may link to or integrate with third-party websites, customer portals, payment systems, telecommunications carriers, application providers, cloud platforms, messaging systems, conferencing tools, and business software.

These third-party services may have their own terms, privacy policies, security practices, and availability conditions.

Where information is shared with a third-party provider to enable a requested service, the applicable processing will be subject to the relevant service arrangements, permissions, and law.

LINXS does not control all independent third-party websites or services and is not responsible for their practices except to the extent responsibility cannot lawfully be excluded.

You should review the terms and privacy policies of third-party services before using them or providing information directly to them.

Google API Services and User Data

If a LINXS application accesses information through Google APIs, LINXS's access to and use of Google user data will comply with applicable Google API Services User Data Policy requirements, including the Limited Use requirements.

Google user data will be used only for purposes disclosed to the user and permitted by applicable Google policies and authorizations. LINXS will not use or transfer Google user data in ways prohibited by those policies.

Where applicable, these restrictions also govern transfers of Google user data to third parties and the use of such data for advertising, analytics, or other purposes.

The actual availability of Google integrations depends on the relevant application and services.

Intellectual Property

Unless otherwise indicated, the website's text, graphics, logos, design, and other materials are owned by LINXS or used with permission and are protected by applicable intellectual property laws.

You may view and use website content for legitimate informational and business purposes. You may not reproduce, distribute, modify, publish, or commercially exploit protected materials without appropriate authorization, except as permitted by law.

LINXS names, logos, and branding may not be used in a manner that implies an unauthorized affiliation or endorsement.

Third-party names, trademarks, software, and content remain the property of their respective owners.

Website Availability and Disclaimer

We strive to maintain an accessible and useful website but do not guarantee uninterrupted, error-free, or continuously available website access.

To the extent permitted by law, the website and its general informational content are provided on an “as is” and “as available” basis, without warranties that are not expressly stated or legally required.

This website disclaimer does not override express warranties, service-level commitments, or other obligations contained in an applicable written customer agreement.

Limitation of Liability

To the maximum extent permitted by applicable law, LINXS will not be liable under these website Terms for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business opportunities, or loss of data, arising from the use of or inability to use the website.

This section applies only to the extent permitted by law and does not exclude liability that cannot legally be excluded or restricted.

Any liability relating to purchased telecommunications services is governed by the applicable customer agreement and mandatory law. Nothing in this section overrides a specific written liability provision applicable to those services.

Indemnification

To the extent permitted by law, you are responsible for unlawful or unauthorized use of the website through your actions and for violations of these Terms.

Any obligation to indemnify LINXS in connection with purchased services, communications activity, customer content, or third-party claims will be governed by the applicable signed agreement and applicable law.

Nothing in these website Terms creates an unlimited indemnification obligation for a customer.

Suspension and Termination of Website Access

LINXS may restrict or terminate access to website features where reasonably necessary to protect website security, prevent abuse, comply with law, or address a violation of these Terms.

Termination of website access does not automatically terminate or modify a separate service agreement.

Any suspension or termination of purchased services is subject to the applicable customer agreement and law.

Governing Law and Disputes

These website Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Any dispute-resolution procedure, venue provision, arbitration requirement, or other dispute term in a signed customer agreement will apply to disputes covered by that agreement.

Nothing in these website Terms limits rights that cannot lawfully be waived.

Changes to These Terms

LINXS may revise these Terms from time to time to reflect changes in our website, services, technology, business practices, or legal obligations.

The updated version will be posted on this page with a revised effective or last-updated date. Where required by law, we will provide additional notice or obtain consent.

Changes will apply prospectively unless otherwise required by law or agreed in writing. Continued website use after updated Terms are posted constitutes acceptance to the extent permitted by law.

Changes to a customer's purchased services, fees, contract term, or other contractual obligations remain subject to the applicable agreement and any required notice or consent.

Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain effective to the extent permitted by law.

These Terms govern general use of the website. They do not constitute the complete agreement for purchased telecommunications services and do not replace a signed service agreement, order form, or other applicable contract.
